User Agreement for Respondents

1. General Provisions

1.1. Who we are.

This User Agreement for Respondents (hereinafter - 'UA') governs the relationship between LLP 'Pwron' (BIN 241040012133), providing services under the brand Gro.now, and individuals participating in activities on the Gro.now platform.

1.2. What is Gro.now.

Gro.now is a unified end-to-end platform (service) for research and feedback: from receiving a brief and generating a survey with an AI bot to distributing surveys through various channels and subsequent analysis in dashboards, including respondent motivation and referral mechanics. Depending on the specific activity, Gro.now may:
  • 1.2.1. act as a platform/intermediary, providing technological infrastructure to Partners; and/or
  • 1.2.2. on behalf of a Partner, conceal the identity of the entity conducting the survey, or conduct the survey independently (in which case Gro.now is a party to the relationship with the respondent for the respective activity).

1.3. Roles of the parties.

For the purposes of this UA, the following roles are used:
  • 1.3.1. 'Respondent' — an individual participating in surveys, contests, and other activities of the Platform (both with and without registration).
  • 1.3.2. 'Partner' – a b2b client of Gro.now that uses the Platform to independently create and/or launch surveys/activities, as well as to receive and analyze results. If the Partner is explicitly named in the survey/contest, it is considered a party to the relationship with the Respondent regarding the content of that activity.
  • 1.3.3. 'Survey/Contest Organizer' — the person indicated in the announcement/activity card as conducting it (Gro.now or a Partner). The Organizer determines the goals, conditions of participation, and rules of the respective activity.

1.4. Territory and language.

  • 1.4.1. This UA is drafted in Russian and applies to relationships arising from the use of the Platform, regardless of the Respondent's location.
  • 1.4.2. The applicable law is the law of the Republic of Kazakhstan.
  • 1.4.3. The version of the UA in effect at the time of the Respondent's participation in an activity is considered proper and applicable (for more details, see Section 3 on acceptance and amendments).

1.5. Scope of the UA.

The UA applies to the Respondent's participation in all activities on the Platform, including:
  • 1.5.1. surveys (both paid and unpaid), including ongoing feedback surveys launched by a Partner for its business;
  • 1.5.2. contests/prize draws/games and other promotional activities;
  • 1.5.3. referral mechanics (if applicable);
  • 1.5.4. other actions for collecting opinions/data through channels supported by the Platform.

The act of a Respondent participating (including without registration) in a specific activity constitutes agreement with the terms of the UA and with the special conditions specified in the interface of that activity (e.g., the presence/amount of a reward).

2. Terms and Definitions

The following terms are used in this UA:
  • 2.1. We, Platform, Service, Gro.now – the software-technological complex and related services of LLP 'Pwron' that provide for the creation, distribution, and analysis of activities (surveys, contests, etc.).
  • 2.2. User – a general term for any individual interacting with the Platform as a 'Respondent'.
  • 2.3. Respondent – an individual participating in surveys, contests, and other activities of the Platform (both with and without registration).
  • 2.4. Registered Respondent – a Respondent who has created an Account on the Platform.
  • 2.5. Unregistered Respondent – a Respondent participating without creating an Account.
  • 2.6. Account, Personal Account — a set of the Respondent's user data on the Platform and the interface for managing participation and settings.
  • 2.7. Survey - a set of questions and instructions, formed by Gro.now and/or a Partner to obtain answers from the Respondent.
  • 2.8. Survey Conditions — the participation parameters displayed in the survey interface (including the presence/absence and amount of reward, deadlines, restrictions).
  • 2.9. Contest – a promotional activity (prize draw, game, quiz, etc.) conducted by the Organizer based on separately published Contest Rules (conditions of participation, criteria for determining winners, prize composition, etc.).
  • 2.10. Activity — a scenario of interaction with the Respondent organized through the Platform, including (but not limited to): Surveys, Contests, referral mechanics, and other actions to collect opinions/data and to accrue/realize rewards/Points.
  • 2.11. Partner – a b2b client of Gro.now that uses the Platform for the independent formation and/or launch of activities, as well as for obtaining and analyzing results. If the Partner is explicitly indicated in the activity information, it is considered a party to the relationship with the Respondent regarding the content of such activity.
  • 2.12. Activity Organizer – the person indicated in the announcement/activity card as conducting it (Gro.now or a Partner). The Organizer determines the goals, conditions of participation, and rules of the corresponding activity.
  • 2.13. Reward – the value provided to the Respondent based on the results of participation (cash payments, certificates, coupons, mobile top-ups, charitable donations, etc.), if such is provided by the Survey Conditions/Contest Rules.
  • 2.14. Points — an internal unit of account, available to Registered Respondents, linked to participation in activities and subject to use/conversion in the manner established by this UA and separate regulations of the Platform.
  • 2.15. Questionnaire/Profile – information provided by the Respondent about themselves during registration/participation (within the limits necessary for the purposes of the activity).
  • 2.16. Answers/Respondent's Materials – information (including text, ratings, comments) provided by the Respondent during participation in an activity.
  • 2.17. Channels of participation – methods of interaction supported by the Platform: messengers (including Telegram/WhatsApp/IG Direct), web chat/web forms, e-mail, QR mechanics, and other channels announced by Gro.now.
  • 2.18. Personal Data, PD — information about the Respondent that relates to an identified or identifiable individual and is processed in accordance with the legislation of the RK and Gro.now documents (Privacy Policy, Cookie Policy, etc.).
  • 2.19. Legal Representative — a parent/guardian of a minor Respondent who gives consent for participation in cases provided for by the UA.

3. Acceptance of the User Agreement and its Versions

3.1. Methods of acceptance.

Acceptance of the UA (full and unconditional acceptance of the terms set forth in the UA) is performed by one of the following methods:
  • 3.1.1. Clicking 'Agree', 'Participate', 'Accept' or a functionally similar button/element in a web form, bot, or other Platform interface signifies full and unconditional acceptance of this UA, as well as the special conditions of a specific activity (Survey Conditions/Contest Rules, if applicable).
  • 3.1.2. In messengers (including Telegram/WhatsApp/IG Direct), if a link to the current version of the UA is present, any further participation by the Respondent in the conversation/activity (including sending a message/reply, reactions, filling out a form) is considered acceptance of the UA and the corresponding special conditions.

3.2. Logging of acceptance.

To confirm the fact and moment of acceptance, the Platform records and stores: (i) the channel of participation (web/specific messenger/other), (ii) the date and time of acceptance, (iii) the identifier/version of the UA in effect at the moment of acceptance. This information may be used as evidence of the conclusion of the UA and agreement with the special conditions of the activity.

3.3. Version of the UA for unregistered Respondents.

For unregistered Respondents, the version of the UA in effect at the time of their participation in a specific activity applies. The link accompanying the activity leads to the current version of the UA.

3.4. Changes to the UA and notification.

  • 3.4.1. We have the right to amend the UA by publishing an updated version on the website/in the Platform's interfaces. Unless otherwise specified, the changes take effect from the moment of publication.
  • 3.4.2. Registered Respondents may be additionally notified of significant changes via their Personal Account and/or the e-mail specified in the Account.
  • 3.4.3. For unregistered Respondents, the rule of clause 3.3 applies: participation after publication means acceptance of the new version of the UA.
  • 3.4.4. In case of disagreement with the changes, the Respondent must refrain from participating in activities, and a Registered Respondent must stop using the Platform and delete the Account (if available).
  • 3.4.5. Historical binding: for relationships that arose before the publication of changes, the version of the UA that was in effect at the time of the corresponding participation applies.
  • 3.4.6. We store previous versions of the UA on the Site for at least 3 years from the date of publication of a new version.

4. User Categories and Account

4.1. Categories of Respondents.

  • 4.1.1. Unregistered Respondent – participates without creating an Account. Can take surveys (including unpaid ones), and if a reward is available, can receive certificates/coupons/mobile top-ups and other forms, as directly specified in the Survey Conditions/Contest Rules. A valid e-mail is required for communication and reward delivery. 'Points' are not accrued to unregistered users, and cash withdrawal is not provided.
  • 4.1.2. Registered Respondent – creates an Account and receives enhanced features, including the 'Points' program. The size and availability of rewards for a registered Respondent may be higher and depend, among other things, on the completeness of the Questionnaire/Profile (level of completion), which is separately indicated in the activity interface (see Section 6).

4.2. Account Creation.

  • 4.2.1. For registration, an e-mail (mandatory) and other data requested by the Platform on the principle of sufficiency for the purposes of participation, payments, and compliance with legislation (including tax law) are required.
  • 4.2.2. We have the right to request confirmation of the e-mail and/or additional information/documents if required for the purposes of payments, performing the functions of a tax agent, ensuring security, and anti-fraud (for more details, see Sections 7-9).
  • 4.2.3. Marketing communications are sent only with separate consent; transactional messages (participation/payment statuses) are sent without separate consent (see Section 12).

4.3. Age and access to participation.

  • 4.3.1. Persons aged 16 and over are allowed to participate with the consent of a legal representative (parent/guardian). We reserve the right to request confirmation of such consent.
  • 4.3.2. Separate activities (in particular, those related to cash payments/prizes) may have a higher age threshold; in case of conflict, the special conditions of the respective activity have priority.

4.4. Contact details and communication.

  • 4.4.1. The Respondent is obliged to maintain the relevance of their e-mail and, if available, other contact details (phone/messenger).
  • 4.4.2. Failure to provide/maintain the relevance of an e-mail may prevent payments and reward notifications. The Respondent bears the risk of non-delivery of messages.

4.5. Rules for using the Account and security.

  • 4.5.1. One Account per Respondent is allowed; multiple accounts, transfer/sale/gifting of an Account to third parties are prohibited.
  • 4.5.2. The Respondent is obliged to ensure the confidentiality of their login credentials and bears the risk of actions performed from their Account. It is recommended to enable available security features (e.g., two-factor authentication, if provided).
  • 4.5.3. Bypassing the Platform's technical restrictions (including through bots, scripts, emulators, mass registrations, VPN/proxy to distort geo-data) is prohibited. Violations may lead to feature restriction, suspension, or blocking of the Account according to the procedure specified in Section 9.

4.6. Account Deletion and Consequences.

  • 4.6.1. A Registered Respondent may delete their Account through the Platform interface or by sending a request to the contacts specified in section 1 of the UA or on the Site.
  • 4.6.2. Deleting an Account terminates access to the Platform's functions, including 'Points' and participation history; however:
  • 4.6.3. the right to request payment for previously accrued cash rewards (if applicable) is retained for 120 calendar days from the date of accrual;
  • 4.6.4. after the expiration of this period, the right to payment is terminated.
  • 4.6.5. Deleting the Account does not affect the validity of previously given acceptances for specific activities and does not cancel obligations that arose before the date of deletion (including tax and other obligations, if applicable).
  • 4.6.6. The processing and storage of data after deletion is carried out in the volume and for the periods provided by legislation and Gro.now documents.

4.7. Data changes and verification.

  • 4.7.1. The Respondent is obliged to promptly update the Questionnaire/Profile regarding information affecting participation and payments.
  • 4.7.2. In case of data discrepancy/refusal of verification, we have the right to suspend participation, accrual/payment of rewards until the discrepancies are resolved (see Sections 7-9).

5. Roles and Survey Conduct Model

5.1. Role Model.

  • 5.1.1. The Partner places/launches surveys through the Platform and receives results for analysis. As a general rule, Gro.now provides the technological infrastructure (platform/intermediary).
  • 5.1.2. Gro.now as Organizer. At the Partner's request, Gro.now may conceal the identity of the person conducting the survey or conduct the survey independently. In such cases, Gro.now is a party to the relationship with the Respondent for the respective activity.
  • 5.1.3. Partner as Organizer. If the Partner is explicitly stated in the survey interface, the Partner is a party to the relationship with the Respondent regarding the content of the survey (goals, question wording, interpretation of answers); Gro.now provides the technical part.

5.2. Survey Conditions.

Each activity is accompanied by special conditions displayed in the interface (hereinafter - Survey Conditions), which take precedence over the general provisions of the UA in case of conflict. Survey Conditions include, among other things:
  • a) who is the Organizer (Gro.now or Partner, if necessary - with an indication of concealment at the Partner's request);
  • b) the presence/absence of a reward and its type/procedure for provision (see Section 7);
  • c) eligibility criteria (age/geo/other), participation deadlines, limits, and restrictions (if necessary);
  • d) the channels and technical requirements used;
  • e) the presence of a reward (if a reward is not specified in the Survey Conditions, it is not provided).
  • f) other special conditions of a specific activity

5.3. Channels of Participation.

Surveys can be conducted through bots (Telegram/WhatsApp/IG Direct, web chat), e-mail/advertising/QR-mechanics, and other supported channels. Answers are aggregated into a single database on the Platform for subsequent analysis. Links to the UA and Survey Conditions are provided in the corresponding interface/message. The acceptance rules are specified in Section 3.

5.4. Types / Model of Conducting Surveys.

  • 5.4.1. Campaigns — one-time or periodic surveys.
  • 5.4.2. Continuous Feedback – 'always-on' surveys/forms (e.g., via a QR code at a Partner's point of sale) for collecting feedback on goods/services without a time limit. Such activities may be unrewarded, unless otherwise specified in the Survey Conditions.

5.5. Transfer of Information to Partners.

The Respondent agrees that information obtained during the survey, as well as provided in the questionnaire/profile, may be transferred to the Partner in the volume necessary for the purposes of the respective activity (analytics, working with feedback, quality control, etc.). The procedure for processing personal data is regulated by Section 12 and related documents (Privacy Policy, Cookie Policy).

5.6. Responsibility for Content and the Right of Suspension.

  • 5.6.1. When the Partner is indicated as the Organizer, they are responsible for the content of the survey, the correctness of the wording, compliance with legislation, and business decisions made based on the survey results. Gro.now provides the technical side.
  • 5.6.2. When Gro.now acts as the Organizer (including cases of concealing the Partner at its request), Gro.now is responsible to the Respondent for the proper conduct of the survey within the limits provided by the UA and Survey Conditions.
  • 5.6.3. Gro.now has the right to remove/suspend a survey at any time (including one launched by a Partner) if there are signs of violation of the law, third-party rights, the integrity of participation, or Platform rules, as well as in case of technical/operational risks. Gro.now is not responsible for the consequences of survey termination for the Partner, except in cases where Gro.now is the Organizer and it is not otherwise expressly provided by law or the UA.

5.7. Third-party Platform Limitations and Technical Risks.

Participation channels (messengers, social networks, email services, telecom operators, and other platforms) are independent of Gro.now. We do not control their rules/availability and do not guarantee uninterrupted operation. Delays/failures/restrictions, changes in interfaces, and tariffs of third parties are possible. By using such channels, the Respondent accepts these risks; interaction with the channel is carried out on the terms of the respective platform.

5.8. Payments and Communications for Surveys.

If the Survey Conditions provide for a reward, the procedure for its accrual/realization is determined by Section 7 and the Survey Conditions themselves. Transactional messages are used for communication about participation and payments (see Sections 4 and 12).
